1. Company Information

2. Informational Purpose & Non-Binding Estimates
All content published on this website — including pricing references, calculators, project galleries, and digital estimates — is provided for general informational purposes only and does not constitute a legally binding offer, guarantee, or contract.
A final and binding project price is established exclusively through:
- A physical or remotely certified on-site inspection by an authorized representative of Fifth Sun Roofing LLC, and
- The full execution of a formal written contract signed by both parties.
3. Maryland Residential Compliance (MHIC)
For all residential home improvement projects in the State of Maryland, Fifth Sun Roofing LLC operates in strict compliance with the Maryland Home Improvement Law (Md. Code Ann., Bus. Reg. §§ 8-601 et seq.) and the regulations of the Maryland Home Improvement Commission (MHIC):
- No mobilization, labor, or physical work will commence without a fully signed written contract.
- Initial deposits for residential projects will never exceed one-third (1/3) of the total contract value, in accordance with MHIC regulations.
- Residential clients retain a legal right to cancel this contract without penalty within five (5) business days of signing. Clients aged 65 years or older retain a right to cancel within seven (7) business days of signing.
- Cancellation must be submitted in writing via email to [email protected] or by certified mail to our registered business address.
4. Hidden Conditions & Change Orders
Initial project proposals are based exclusively on visible and accessible conditions observed during the pre-project inspection. Concealed or latent defects — including but not limited to rotted plywood decking (the structural wood base beneath the roof covering), deteriorated underlayment (the protective layer below roofing shingles), damaged rafters, or unforeseen structural issues — may only be discovered during the tear-off phase (the removal of the existing roof covering).
In the event that hidden conditions are discovered:
- The total project cost may be adjusted to reflect additional labor and/or materials required.
- All adjustments will be formalized and presented to the client through a written or digitally executed Change Order before any additional work proceeds.
- No extra work will be performed without the client’s explicit written approval.
5. Payment Terms & Late Payment Policy
All clients are required to adhere to the milestone payment schedule established in the formal project contract. The standard payment structure is as follows:
- Deposit (30% of total contract value): Due upon contract execution, to secure the project start date and authorize material procurement.
- Progress Payment: Due upon completion of defined project milestones, as specified in the contract.
- Final Payment: Due upon satisfactory completion of the project and final client inspection.
Late Payment Consequences:
- Balances unpaid beyond the due date specified in the contract will accrue a finance charge of 1.5% per month (18% per annum) on the outstanding amount.
- Fifth Sun Roofing LLC reserves the right to suspend all on-site work without liability in the event of non-payment or material breach of the payment terms.
- In cases of extended non-payment, the Company reserves the right to file a mechanics lien against the property in accordance with Maryland law (Md. Code Ann., Real Prop. §§ 9-101 et seq.).
6. Permits & Regulatory Compliance
Fifth Sun Roofing LLC will identify and manage all required permits for each project in compliance with applicable county and municipal building codes in the State of Maryland. The client is responsible for granting reasonable access to the property for inspection and permit posting purposes.
For projects that include solar energy system installation, additional permits may be required, including electrical permits, structural permits, and utility interconnection agreements (Net Metering applications). Fifth Sun Roofing LLC will coordinate all applicable regulatory filings.
7. Limitation of Liability & Force Majeure
Fifth Sun Roofing LLC shall not be held liable for project delays, suspensions, or cancellations caused by circumstances beyond the Company’s reasonable control, including but not limited to:
- Severe weather events, storms, or natural disasters.
- Government-issued permit backlogs or regulatory delays.
- Material shortages, supply chain disruptions, or manufacturer delays.
- Acts of God or other force majeure events.
In all force majeure scenarios, Fifth Sun Roofing LLC will provide timely written notice to the client and will reschedule project activities as promptly as conditions allow. The Company’s total liability for any claim shall not exceed the total value of the executed project contract.
8. Workmanship Warranty & Manufacturer Warranties
Fifth Sun Roofing LLC provides a workmanship warranty on all completed roofing installations as specified in the executed project contract. Manufacturer material warranties (shingles, membranes, panels) are issued directly by the respective manufacturer and are subject to the manufacturer’s terms and conditions.
Warranties are void if:
- Damage results from events beyond normal weathering (e.g., hurricane, hail beyond standard impact ratings, structural failure unrelated to the roofing system).
- Unauthorized repairs or modifications are made to the roofing system by a third party.
- The client fails to maintain the roofing system in accordance with standard maintenance recommendations.
9. Intellectual Property
All content on this website — including text, images, project photography, logos, graphics, and video — is the exclusive property of Fifth Sun Roofing LLC or its licensed content providers and is protected under applicable U.S. copyright and intellectual property laws. Unauthorized reproduction, distribution, or use of any content without prior written consent is strictly prohibited.
10. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Maryland.
The parties agree to attempt good-faith negotiation to resolve any dispute prior to initiating formal legal proceedings. If resolution cannot be reached, disputes may be submitted to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).
